Residence visa without the right to work

A residence visa for non-profit residency in Spain (work or professional activity) provided that the applicant has guaranteed and sufficient means of subsistence. This visa does not grant the right to work.

The following family members may also obtain a visa:

  • The spouse, registered partner, or regular partner of the person applying for a residence permit, duly certified.
  • The minor children of the applicant or their spouse, registered partner, or regular partner, who are not married or have not formed their own family.
  • The adult sons and daughters of the applicant or their spouse, registered partner, or regular partner, who have a disability requiring support or who are objectively unable to provide for their own needs due to their health condition.

Procedure

This Consulate in Moscow is authorized to accept visa applications from individuals residing within the consular district.

All non-commercial residence permits require an initial residence permit, which is obtained at the same time as the visa application.

  • Applicant Requirements: The visa application must be submitted in person by the applicant. If the applicant is a minor, the application may be submitted by one of the parents or guardians.
  • Visa Application Deadline: The visa application must be submitted within one month from the day following the day of receiving a positive decision on the residence permit.
  • Submission of Additional Documents: The Consular Section may request missing documents from the applicant or provide additional documents or information necessary to process the application. It may also summon the applicant for an in-person interview.
  • Decision Making Time: The statutory deadline for making a decision is one month from the day following the day the application is submitted directly to the Consulate General.
  • Visa Collection: The visa must be collected in person by the applicant. The visa approval notification will indicate the deadline and time of issue.
  • Visa Refusal: In the event of a visa refusal, notification will always be in writing, stating the reasons on which the decision is based.
  • Appeal: In the event of a visa refusal, the applicant may file an appeal for review of the decision with the Consular Post within one month from the day following the day of receipt of the refusal notification. They may also file an administrative appeal with the Supreme Court of Madrid within two months from the day following the day of receipt of the visa refusal notification or the rejection of the appeal for review.

Visa Validity: The visa is valid for 365 days. Upon arrival in Spain, you must apply for a foreigner's identity card within one month of entering the country at the Foreigners' Office or the relevant police station.

All foreign documents must be legalized or apostilled, and if they are written in a language other than Spanish, they must be accompanied by a corresponding translation.

1. National Visa Application Form. The applicant must complete all sections and sign the visa application form. If the applicant is a minor, the form must be signed by one of their parents or guardians, or a duly authorized representative.

2. Application for a non-working residence permit. Each applicant must complete all sections and sign one copy of Form EX-01.

3. Photograph. Two color photographs against a white background, taken full-face, without sunglasses, glare, or clothing obscuring the oval of the face.

4. Valid Passport. You must provide the original and a full photocopy of all current passports, including the one used to submit the application. The passport must be valid for at least one year and have two blank pages. Passports issued more than 10 years ago will not be accepted.

5.- A photocopy of all pages of your regular passport. For Russian citizens only.

6.- Proof of sufficient financial resources. It is necessary to provide original and copies of documents confirming the applicant's sufficient financial resources to cover living expenses in Spain during the first year of their residence permit, or a regular source of income for themselves and, if necessary, accompanying family members. The minimum required amount is 400% of the IPREM (Income Available for Multiple Effects). An additional 100% of the IPREM must be added for each dependent family member of the applicant. The IPREM figure is available separately.

7.- Medical certificate. Original and a copy of a medical certificate confirming the absence of any illnesses that could have serious public health consequences in accordance with the International Health Regulations 2005. If the certificate is issued in a language other than Spanish, it must be accompanied by a corresponding Spanish translation, either by a sworn translator or legalized by the Consulate.

7.- Certificate of no criminal record. Applicants who have reached the age of majority must provide the original and a copy of a certificate of no criminal record issued by their country or countries of residence within the last 5 years. This certificate must be translated and legalized. Certificates issued in the Russian Federation, Belarus, Armenia, and Uzbekistan must have a Hague Apostille. Certificates issued in Turkmenistan must be signed by a diplomatic representative of the relevant consulate in the Russian Federation.

Certificates of no criminal record must be certified with a Hague Apostille. However, if the certificate is issued to a citizen of the European Union by the authorities of the Member State of which they are a citizen, an apostille is not required. You can find a list of countries that have signed the Hague Convention.

If the country in which the applicant has resided for the last five years is not a party to the 1961 Hague Convention, the certificate of no criminal record must be certified by the Ministry of Foreign Affairs of the issuing country, and then by the Spanish consulate in that country. The certificate of no criminal record must be accompanied by a translation into Spanish (if the original is not in Spanish). The translation must be done by a sworn translator or a legal translator Licensed at the consulate.

8.- Health insurance. Original and a copy of a public or private health insurance certificate issued by an insurance company authorized to operate in Spain. The insurance must cover all risks covered by the Spanish public healthcare system.

9.- Proof of residence within the consular district. Visa applications may be submitted by citizens and legal residents of the consular district in which they reside. Method of proof of residence:

  • Citizen of the Russian Federation. Internal passport.
  • Citizens of other countries under our jurisdiction: international passport.
  • Citizens of other countries residing within our consular district. Residence permit.

10. Permission obtained from legal representatives. If the applicant is a minor, the original and a copy of a notarized declaration with a Hague Apostille from the parents or guardians authorizing the minor's transfer to Spain must be provided, with the document identifying the person responsible for the minor in Spain. The documents must be accompanied by an official translation into Spanish and a legalization of the translation.

11. Visa fee payment. The visa and residence fee is mandatory and must be paid upon submission of the application. Fees are paid in local currency and are regularly updated depending on exchange rate fluctuations.

Documents required for family members.

Each family member must present:

  • All requirements specified in sections 1, 2, 3, 4, 6, 7, 8, 9, and 10. For minors, the visa application and residence permit application must be signed by one of their parents.
  • Documents proving the relationship with the applicant: birth or marriage certificates issued by the Civil Registry Office, civil partnership certificate, or any other document proving the relationship as an unregistered partner. A translation of the document into Spanish must also be provided; this translation must be performed by a sworn translator or legalized at the Consulate.

If necessary, to evaluate the application, the consular section may request additional documents or information and may invite the applicant for an in-person interview.

Please provide one recent photograph (not more than 3 months old) of yourself, which should not have been used previously in the passport. The photograph should be in colour and:

  • The photograph MUST be in colour and have only a white background.
  • The photograph must have been taken within the last six months.
  • The photograph must be submitted glued to the application form.
  • The photo submitted must measure: 3.5 cms x 4.5 cms with the head centred in the frame. The head (measured from the top of the hair to the bottom of the chin) should measure about 3 cms.
  • The photograph must be a full-face front view in which the visa applicant is facing the camera directly.
  • In general, the applicant's head, including both face and hair, should be shown from the crown of the head to the tip of the chin on top and bottom and from hairline side-to-side. It is preferable that ears be exposed.
